THE HON'BLE THE CHIEF JUSTICE HIMA KOHLI
AND
THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY
F.C.A. No.147 OF 2011
JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1.
An application has been moved by learned counsel for the appellant-husband stating inter alia that the present appeal may be allowed by granting a decree of divorce in favour of the parties in view of a compromise arrived at between them.
2. We decline to entertain any such request. If the parties have arrived at a compromise in terms of the Memorandum of Joint Compromise enclosed with the present application dated 02.12.2020, it is for them to approach the learned Family Court by moving an application for seeking divorce by mutual consent and following the procedure prescribed in accordance with law.
3. The present appeal is disposed of along with the pending applications, in view of the settlement arrived at between the parties, while leaving them to approach the Family Court with an appropriate application in this regard.
