JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. Learned counsel for the appellants states that his clients have
taken the brief back from him last week and granted him discharge.
2. If that is so, then the appellants should have made alternate
arrangements for being represented today. However, none is present
on behalf of the appellants, nor are the appellants present.
3. Mr. Harender Pershad, learned Special Government Pleader
informs the Court that during the pendency of the appeal, the
appellants have filed a fresh writ petition challenging the order dated
20.11.2019 passed in W.P.No.19964 of 2019, wherein one of the
grounds taken is that the said order has been passed without
impleading them. It is stated that the said petition is pending
consideration before the learned Single Judge.
4. He further states that pursuant to the orders passed in the
present proceedings, the respondent No.5 has passed an order
revoking the licence granted to the appellants to run a petrol bunk from the subject site, which is subject matter of the pending writ petition.
5. In view of the fact that the appellants have sought appropriate legal recourse on the proceedings dated 01.09.2020 passed by the W.A.No185 of 2020 Page 1 of 2 2 respondent No.5, the present appeal is disposed of along with the pending applications, if any, while reserving the right of the appellants to pursue the said petition and the right of the respondents to contest the said petition in accordance with law.
