-2-
HONOURABLE SRI JUSTICE P.NAVEEN RAO
WRIT PETITION No.2786 of 2021
ORDER :
Heard learned counsel for petitioner and learned Special Government Pleader for Home.
2. In the selections conducted pursuant to recruitment notification issued in the year 2012, petitioner was selected and appointed as Stipendiary Trainee Constable in the Special Police Force on 21.01.2013. After successful completion of nine months induction training, he was appointed as constable and was placed on probation. While on probation, notice was issued on 04.02.2015 calling upon the petitioner to explain why his probation should not be terminated on the ground of unauthorized absence for six days. Though, petitioner submitted his explanation giving reasons for his absence, not satisfied with the explanation offered by the petitioner, the Commandant of Special Protection Force terminated the probation of petitioner by orders dated 10.03.2016. Aggrieved thereby, petitioner preferred the appeal to the Director General of Police (D.G.P.), Special Protection Force. The D.G.P. while rejecting the appeal vide his orders dated 04.04.2017 also referred to the subsequent involvement of petitioner in criminal proceedings.
3. Since D.G.P. referred to pending criminal case, petitioner waited till the criminal Court pronounces judgment in S.C.No.154 of 2017. By judgment dated 14.05.2018, petitioner was acquitted in the said case. On 13.03.2019, petitioner submitted representation to the Principal Secretary to Government, Home Department requesting to review the decision to terminate his -3- probation and to reinstate into service. On 09.05.2019, he also submitted representation to the D.G.P.
4. This writ petition is filed alleging inaction on the representations submitted by the petitioner.
5. Having regard to the chronology of events noted above, I deem it proper, in the facts of the case, to dispose of writ petition at the admission stage. Writ petition is disposed of directing the Government to consider representation submitted by petitioner on 13.03.2019 requesting to review the decision to terminate the probation of the petitioner as expeditiously as possible preferably within a period of eight weeks from the date of receipt of a copy of the order. Pending miscellaneous petitions, if any, shall stand closed.
