WRIT PETITION No.2808 OF 2021
ORDER:
1 In this Writ Petition the petitioner sought a direction to the 2nd and 3rd Respondents to immediately grant approval for the kidney transplantation from 2nd Petitioner to the 1st Petitioner in an expedited and a time bound manner.
2 It is the case of the petitioners that despite their best efforts, the 3rd respondent has not considered his case and aggrieved thereby the petitioners approached the 2nd respondent - appellate authority and addressed a letter dated 19.12.2020 and the same is pending. 3 Since the petitioners have already made a representation before the 2nd respondent and if the Writ Petition is kept pending the health condition of the patient - 1st petitioner will get deteriorated, the present Writ Petition can be disposed of at the admission stage with the following direction.
4 Accordingly, this Writ Petition is disposed of directing the 2nd respondent to decide the letter dated 19.12.2020 addressed by the petitioners considering the factors with more concern in favour of the 1st petitioner within a period of two working days from the date of receipt of a copy of this order. The petitioners shall also sensitize the 2nd respondent with any judgment or any other material that is in their favour. No order as to costs.
5 Miscellaneous petitions if any pending in this Writ Petition shall stand closed.
