CRIMINAL REVISION CASE No.960 of 2008
JUDGMENT :
This criminal revision case is filed, aggrieved of the order dated 04.04.2007 in M.C.No.18 of 2005 on the file of X Metropolitan Magistrate, Cyberabad at Malkajgiri, Ranga Reddy, whereby, the learned trial Court has awarded the sum of Rs.3,000/- per month to each of respondents 1 and 2 herein towards maintenance from the date of petition, on or before 10th of every month.
2. The revision petitioner contends in this revision that the trial Court has granted excess amount towards maintenance as he used to earn only Rs.6,000/- per month and that later, he voluntarily retired from service.
3. On perusal of the entire material on record, I am of the considered view that the trial Court has passed the aforesaid order granting maintenance @ Rs.3,000/- per month to respondents 1 and 2 herein, after thoroughly considering the evidence on record and taking into account the income of the petitioner herein. Therefore, I do not find any illegality or infirmity in the order impugned, awarding maintenance to respondents 1 and 2 herein, who are none other than the wife and daughter of the revision petitioner respectively.
4. Accordingly, this criminal revision case is dismissed.
Pending miscellaneous applications, if any, shall stand closed.
