WRIT APPEAL No.129 of 2014
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of order dated
26.07.2013 passed in Review WPMP.No.23721 of 2012 in
W.P.No.5946 of 2012 by the learned Single Judge.
The facts of the case reveal that the writ petitioner came
up before this Court with the grievance that his price bid was
not opened and the learned Single Judge allowed the writ
petition directing the respondents in the writ petition to open
and consider the price bid of the writ petitioner along with others. Aggrieved by the said order, the writ petitioner preferred a review petition and the same was dismissed by the learned Single Judge on 26.07.2013 against which the present writ appeal has been filed.
The order was passed in 2013 and we are in 2021. As the price bid was directed to be opened in 2012, the question of deciding the matter on merits at this stage does not arise. However, it is made clear that in case the cause of action still survives or the State is still aggrieved in the matter, the State shall certainly be free to file an appropriate application for revival of the writ appeal.
With the aforesaid, the writ appeal is disposed of. 2 Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
