However, considering the request of the appellant to withdraw this appeal stating that during the pendency of this appeal, there was a compromise between the parties in the E.P. proceedings, this appeal suit is dismissed as withdrawn, confirming the judgment and decree in O.S.No.49 of 2011 on the file of Principal District Judge, Mahabubnagar. No order as to costs.
