THE HON'BLE THE CHIEF JUSTICE SATISH CHANDRA SHARMA
AND
THE HON'BLE SRI JUSTICE N. TUKARAMJI
W.A.No.890 of 2019
JUDGMENT: (Per the Hon'ble the Chief Justice Satish Chandra Sharma)
The present writ appeal is arising out of the order dated
14.10.2019
passed by the learned Single Judge in W.P.No.22035 of 2019.
The learned Single Judge has directed the Tahsildar to carry out survey/demarcation and the same has already been done. At this stage, learned counsel for the appellant has informed this court that the appellant has filed a writ petition i.e., W.P.No.4256 of 2020, challenging the survey carried out by the Tahsildar.
In the light of the aforesaid fact that the survey has already been carried out and a subsequent writ petition has been filed, no further orders are required to be passed in the present writ appeal.
The writ appeal stands disposed of. It is made clear that the observations made by the learned Single Judge or by this court will not come in the way of the rights of the parties in respect of pending litigation.
Pending miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
