JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.     Mr. B.S.Prasad, learned Advocate General appearing for the

appellant states that Mr. Y. Rama Rao, learned counsel for the

respondent has not approached him for receiving a Cheque of

Rs.40,52,985/- calculated as payable towards compensation to the respondent.

2. Mr. Y. Rama Rao, learned counsel for the respondent states that he has received instructions from his client only recently that without prejudice to her rights, she is willing to accept the Cheque.

3. Learned Advocate General states that he shall send the Cheque to learned counsel for the respondent in the course of the day. He further states that an Award in respect of the subject land shall be passed in the month of September itself.

4. In view of the submission made by learned Advocate General, which is accepted by learned counsel for the respondent, the present appeal is closed along with the pending applications, if any, by quashing the fine of Rs.25,000/- imposed on the appellant.
