COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.     Learned counsel for the appellant/wife states that during the

pendency of the present appeal, parties have arrived at an out of court

settlement in terms of a Memorandum of Understanding dated

26.02.2021 executed by them.        He states that out of a sum of

Rs.30,00,000/- that the respondent/husband has agreed to pay to the

appellant/wife, a sum of Rs.27,50,000/- towards full and final settlement, that has already been received. It has been agreed that the balance amount shall be paid by the respondent/husband to the appellant/wife, after the criminal appeal filed by the respondent/husband is closed. Learned counsel states that in view of the aforesaid developments, his client does not wish to press the present appeal, which may be disposed of.

2. The Settlement Agreement is taken on record. The prayer made in I.A.No.1 of 2021 is allowed and the application is disposed of. The appeal is also disposed of along with the pending applications, if any, in terms of the settlement arrived at between the parties as recorded in I.A.No.1 of 2021.
