JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)

1.

The matter is listed in the category of dismissal. Learned counsel enters appearance for the appellant and tenders an apology for his absence on the last date of hearing explaining that he was suffering from viral fever and could not login to the hearing. He states today that he has filed a Memo dated 06.08.2021 stating inter alia that he made efforts to serve a personal notice on his client through registered post for permission to withdraw the appeal, but the same has been returned with an observation that no person resides at the address given. The original postal receipt and the office copy of the notice returned under postal cover dated 02.08.2021 have been enclosed with the Memo. Learned counsel states that he is unaware of the whereabouts of his client and no further address is available with him.

2. It appears that the appellant is not interested in prosecuting the present appeal, which is accordingly dismissed for non-prosecution along with the pending applications, if any.
