JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)


1.     The appellants (writ petitioners in W.P.No.13849 of 2021) are

aggrieved by an interim order dated 23.06.2021, passed by the learned

Single Judge whereby, a stay application (IA.No.1 of 2021) moved by

them for suspending the operation of G.O.Ms.No.10 dated

27.02.2021, issued by the respondent No.1 and the consequential

show cause notices, has been dismissed.

2. Having perused the impugned order that refers to the order dated 26.12.2018 passed in W.P.No.46869 of 2018 and the order dated 27.12.2019 passed in Contempt Case No.714 of 2019 wherein, the writ petitioners in W.P.No.46869 of 2018 had raised a grievance of non-compliance of the undertaking recorded on behalf of the State in the order dated 26.12.2018, we are prima facie of the opinion that the impugned order does not warrant any interference.

3. At this stage, Mr. C. Damodar Reddy, learned Senior Advocate appearing on behalf of the appellants states that instead of pressing the present appeal, he is ready to address arguments in the writ petition itself. However, we are informed that pleadings in the writ petition W.A.No.336 of 2021 Page 1 of 2 have yet to be completed. Though a counter affidavit has been filed by the official respondents recently, rejoinder has yet to be filed. Learned Senior Advocate states that the rejoinder shall be filed within two weeks. Both the parties are agreeable to addressing arguments in the writ petition for a final adjudication.

4. In view of the submission made hereinabove, the present appeal is disposed of as not pressed along with the pending applications, if any. The appellants shall file a rejoinder to the counter affidavit filed by the respondents in W.P.No.13849 of 2021 within two weeks. Registry is directed to list W.P.No.13849 of 2021 before the learned Single Judge as per roster, on 08.09.2021. The parties shall appear before the learned Single Judge on the said date and request that a date to be fixed for final arguments in the writ petition.
