                 APPEAL SUIT No. 485 of 2003

JUDGMENT:

Learned counsel for both the parties had prayed that this Appeal Suit may be disposed of in terms of the compromise memo. A compromise memo had been filed under Order XXIII Rule 3 CPC to that effect.

Today, when the matter is taken up, the parties are present in the Court and have produced their respective identity proofs. They are all identified personally by the learned counsel appearing for them. They have stated before this Court that on the advice of the elders, they had settled the dispute among themselves and all of them agreed that out of their own free will and volition, they entered a compromise memo, which was reduced into writing. A perusal of the said compromise memo discloses that in the signatures portion, Sl.No.4 is kept blank. It is to be noted that respondent No.4 is no more and her legal representatives had been brought on record as respondent Nos.11 to 13. Site Plans had also been enclosed thereto.

CKR, J 2 A.S.No.485 of 2003 In those circumstances, A.S.No.485 of 2003 is disposed of in terms of the compromise memo, which shall form part of the decree.

Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
