WRIT PETITION No.11391 of 2021
ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to issue a writ, order or direction more particularly, to declare the action of respondent Nos. 2 and 3 in not granting police aid to the petitioner pursuant to the representation, dated 23.01.2021, whereby the petitioner has sought for police aid for implementation of the decree and judgment in O.S.No.69 of 2013, dated 09.12.2013 passed by the I Additional District Judge, Medak at Sangareddy, whereby the 4th respondent was interfering with the peaceful possession and enjoyment of the petitioner over land of Ac.1.20 guntas in Survey No.156, Patancheru Village and Mandal, Sangareddy District, as arbitrary and illegal and consequently, direct respondent Nos.2 and 3 to extend the police aid to the petitioner for implementation of aforesaid decree and judgment.
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home. Perused the record.
3. The petitioner herein is the owner of land admeasuring Ac.1.20 guntas in Survey No.156, Patancheru Village and Mandal, Sangareddy District. When the 4th respondent is interfering with the petitioner's peaceful possession and enjoyment over the aforesaid property, he has filed a suit in O.S.No.69 of 2013 on the file of I Additional District Judge, Medak at Sangareddy, seeking perpetual injunction and the same was decreed on 09.12.2013. According to the learned counsel for the petitioner, the said decree and judgment has attained finality. The petitioner herein has submitted a representation on 23.01.2021 to respondent Nos.2 and 3 requesting them to provide police aid in respect of the subject property. Despite receiving the acknowledging the said representation, respondent Nos.2 and 3 did not act upon the same. Therefore, the present Writ Petition has been filed.

Vide representation, dated 23.01.2021, the petitioner has sought police aid by duly enclosing a copy of the said decree and judgment and also copy of Sale Deed etc. Respondent Nos.2 and 3 have received and acknowledged the said representation. Respondent No.2 has also made an endorsement to respondent No.3 to take action in accordance with law. Even then, respondent No.3 has not acted upon it.

In view of the same and considering the above said facts, respondent No.3 is directed to consider the representation, dated 23.01.2021, submitted by the petitioner and pass appropriate orders in accordance with law, considering the fact that there is a decree and judgment in favour of the petitioner herein and against the 4th respondent, within a period of two (2) weeks from the date of receipt of a copy of this order.
Miscellaneous petitions, if any, pending shall stand closed.
