COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Hima Kohli)
1. The appellant in C.A.No.8 of 2011 Mr.B.R.V.Susheel Kumar,
Director of Mines & Geology is virtually present before the court
today.
2. Learned counsel for the respondents fairly states that she does
not wish to oppose the present appeals directed against the order dated 23.08.2011 passed by the learned Single Judge in C.C.No.1476 of 2010 wherein, the appellants have been directed to undergo detention in civil prison for a period of 15 days and pay a fine of Rs.2,000/- each, on the ground that the quarry lease has already expired and the writ petition stands disposed of.
3. In view of the submission made hereinabove, the impugned order insofar as it has directed the appellants to undergo detention in civil prison and pay a fine of Rs.2,000/- each is set aside, while maintaining the rest of the order.
4. The present appeals are closed along with the pending applications, if any.
