At the outset, we have requested learned counsel for the appellant to address this court on the maintainability of the present appeal when the writ petition itself is pending and notice has been issued thereon.
2. Learned counsel for the appellant seeks leave to withdraw the present appeal while reserving the right of his client to approach the learned Single Judge with a prayer for fixing a date in the pending writ petition.
3. Leave, as prayed for, is granted. The present appeal is dismissed as withdrawn along with the pending applications, if any.
