Order 15/01/2026

1. A joint submission has been made by learned counsels for the claimants and the Insurance Company that a compromise has been entered into between the parties in the spirit of Lok Adalat.

2. Learned counsel Mr. Vishal Singhal submits that he has been authorised by the Insurance Company to enter into the said compromise.

3. The present civil misc. appeal has been preferred by the appellant-Insurance Company against the judgment dated 28.12.2018 passed in MAC Case No.403/2011 (62/2014) by learned Motor Accident Claims Tribunal, Bikaner, whereby claim petition of the claimants seeking compensation was partly allowed holding Insurance Company also jointly and severally liable to pay compensation of Rs.18,84,608/- with interest @ 7% per annum.

In view of the above and in the spirit of Lok Adalat, the impugned award is modified and now, the Insurance Company shall pay a lump sum amount of Rs.12,00,000/- to the claimants as a full and final settlement of the case in addition to the amount (50% with interest) already deposited. The amount so agreed shall be deposited by the Insurance Company with the Tribunal within a period of three month from today, failing which, the same shall carry interest @7.5% per annum from the date of this order till actual realization. 5. With the above observations, the present misc. appeal is disposed of.
