Order 25/09/2025
1. The present writ petition has been filed aggrieved of notice dated 14.08.2025 (Annexure-13) whereby the petitioner has been called upon to explain as to why the departmental proceedings be not initiated against him.
2. The issue for which the notice has been served on the petitioner is that his educational as well as technical qualification is/was not in accordance with the requisite qualification.
3. Admittedly, a reply to the notice has been filed by the petitioner whereby all the grounds have been raised by him (Uploaded on 25/09/2025 at 04:22:57 PM) (Downloaded on 25/09/2025 at 10:12:19 PM) [2025:RJ-JD:43085] (2 of 2) [CW-17592/2025] including that both the issues have already been settled by the judgment of this Court passed in a bunch of writ petitions led by S.B. Civil Writ Petition No.15498/2025; Lakshmi Kumari Acharya vs. State of Rajasthan & Ors. (decided on 19.08.2025) and judgment of this Court at Jaipur Bench passed in a bunch of writ petitions led by S.B. Civil Writ Petition No.1457/2021; Jahida Salma vs. State of Rajasthan & Ors. (decided on 10.02.2022).
4. In view of the above, this Court is not inclined to interfere at this stage.
5. As a reply has already been filed by the petitioner, the respondent authorities shall be under an obligation to consider the said reply and thereupon passed a speaking order.
6. Needless to observe that if any order is passed against the petitioner, he would be at liberty to file afresh.
7. With the above directions, the present writ petition stands disposed of.
8. Stay petition and pending applications, if any, stand disposed of.
