1. The instant petition has been filed by the petitioner challenging the order dated 17.03.2025, passed by the learned Judicial Magistrate, Siwana, District Balotra, in Execution Proceedings, whereby his application was rejected with a direction that, if he seeks the relief claimed, he shall file an application before the learned Family Court, Balotra.
2. After some arguments, learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to move an appropriate application before the learned Family Court, Balotra, while placing reliance upon the judgment of the Hon'ble Supreme Court rendered in Rajnesh v. Neha, (2021) 2 SCC 324.
3. In view of the submissions made, the instant petition is disposed of as withdrawn with liberty, as prayed for. Pending applications, if any, also stand disposed of.
