HON'BLE MR. JUSTICE CHANDRA PRAKASH SHRIMALI Judgment 19/06/2025

1. The corpus has been traced and produced before this Court by Sub-Inspector Kanaram P.S. Barloot, District Sirohi.

2. We have conferred with the corpus and she has expressed her free will to accompany the petitioner, who is her mother provided that the petitioner furnishes an undertaking that her marriage shall not be solemnized before she attains the age of 18 years.

3. The petitioner Ms. Kanchan Devi is present in person before this Court along with her counsel Mr. Jagatveer Singh Deora. They are ready to furnish the undertaking as aforesaid, whereby the petitioner abided herself from marrying the corpus until she attains the age of 18 years, whereafter, her desire shall be considered for marriage purposes. The undertaking so submitted by the petitioner is hereby taken on record.

4. As on date, the Sub-Inspector is directed to handover custody of the corpus to the petitioner and they shall be escorted safely to their residence.

5. The present Habeus Corpus Petition is disposed of accordingly. Rule is discharged.
