      Learned counsel for the petitioner has submitted that the

instant petition is squarely covered by the dictum of this Court

enunciated in SBCWP No. 7936/2007 titled Rajasthan Public

Service Commission Versus Commissioner, Persons with

disabilities and ors. and can be adjudicated accordingly.

      When the matter was called for hearing today, none has

marked attendance qua the respondents to refute the contentions

levelled by learned counsel for the petitioner.

In light of the aforesaid facts and circumstances and considering the judgment cited at the Bar, it is evident that the instant matter is of an akin and indistinguishable nature with that (Downloaded on 24/05/2024 at 09:45:25 PM) [2024:RJ-JP:21881] (2 of 2) [CW-5627/2009] of judgment in Commissioner, Persons with disabilities and ors (supra).

Accordingly, the instant petition is allowed. The impugned order dated 13.01.2009 is quashed and set aside.

Pending applications, if any, stands disposed of.
