1. Learned counsel for the petitioner submits that despite possessing the requisite qualifications of BLIS, DLIS and CLIS, the petitioner has not been considered eligible for appointment as Physical Education Teacher in the Elementary Education (Downloaded on 26/02/2024 at 08:43:29 PM) [2024:RJ-JD:9679] (2 of 2) [CW-2392/2024] Department in the higher pay bracket. He submits that similarly situated persons have been accorded benefit in pursuance to the directions granted in the case of Jassa Ram Choudhary and Ors. vs. State of Rajasthan and Ors.; S.B. Civil Writ Petition No.17901/2023 (decided on 09.11.2023).
2. Learned counsel further submits that his grievance would be taken care of if he be permitted to file a fresh representation before the authorities and the authorities be directed to decide the same in terms of the judgment as passed in the case of Jassa Ram Choudhary (supra).
3. In view of the submission made, the present petition is disposed of with the direction to the respondent authorities to decide the representation of the petitioner, if filed within a period of 15 days from the date of this order. It is further directed that the representation be decided within a period of six weeks from the date of filing of the same, totally in accordance with law.
