HON'BLE MR. JUSTICE GANESH RAM MEENA Judgment / Order 12/09/2023

1. The petitioner-college has filed the present writ petition with the prayer to quash and set aside the impugned order dated 31.10.2019, issued by the respondent-University to carry out the inspection of the petitioner- college for the purpose of extension of provisional affiliation for academic session 2019-20.

2. The respondents have filed reply to the writ petition. In para three of the reply, it has been stated that the letter dated 31.10.2019 was sent to the petitioner-college due to mistake and human error and coming in notice of the sad mistake, the answering respondent has rectified the same by sending message (Downloaded on 11/11/2023 at 07:58:07 PM) [2023:RJ-JP:22138] (2 of 2) [CW-18719/2019] again on the same day informing that the earlier message may be treated as cancelled.

3. The contents of para three of reply are quoted as under:_ "That it is humbly submitted that the affiliation branch of the answering university has send mail in matter of inspection of the concern college on 31.10.2019 in matter of affiliation for the session 2019-20 attaching the Letter dated 31.10.2019 (Annexure-7) and same time it was also send to the petitioner college due to mistake and human error and coming in notice of the sad mistake, the answering respondent has rectified the same by sending message again on the same day itself i.e. 31.10.2019 informing that the earlier message may be treated as cancelled as same was send due to technical mistake. The print of E-Mail Message dated 31.10.2019 is being submitted herewith and marked as ANNEXURER-1/1."

4. Alongwith the reply, the respondents have also enclosed the copy of E-mail Correspondence.

5. In view of the specific averments made in the reply to the writ petition and the E-mail Correspondence (Annexure R-1/1), the cause of action no more survives in the present writ petition, therefore, the present writ petition is dismissed as having become infructuous.

6. Since the main petition has been dismissed, the stay application and all other pending application/s, if any, also stand dismissed.
