HON'BLE MR. JUSTICE GANESH RAM MEENA Judgment / Order 02/09/2023

1. The present writ restoration application has been filed by the applicant for restoration of S.B. Civl Writ Petition No.7095/2017 which was dismissed in non-prosecution vide order dated 27.07.2023, because no one appeared on behalf of the petitioner in the second round.

2. Counsel for the applicant-petitioner submits that on 27.07.2023, he could not appear before the Court when the case was called because of his ill health. Counsel further submits that (Downloaded on 11/11/2023 at 07:45:08 PM) [2023:RJ-JP:20498] (2 of 2) [WRES-145/2023] the matter pertains to claim of inclusion of certain mining minerals in the lease of mining, issued in favour of the applicant-petitioner.

3. Considering the reasons mentioned in the application as well as the issue involved in the present writ petition, this Court deems it just and proper to restore the S.B. Civl Writ Petition No.7095/2017 to its original number.

4. Accordingly, the present writ restoration application stands allowed.
