It is stated in the application that the dispute between the parties has amicably been settled and under the compromise dated 06.04.2023, the respondents have agreed that the subject land shall be used by the appellant-Government Shrikrishan Upper Primary School, Fatehpur Shekhawati Distt. [2023:RJ-JP:31279] (2 of 2) [CSA-998/2011] Learned counsel for the appellant/applicant submits that the civil second appeal be allowed in terms of compromise dated 06.04.2023 entered into between the parties.
Learned counsel for the respondents, acknowledging the terms of the compromise dated 06.04.2023, submits that he has no objection if the civil second appeal is disposed of in terms of the aforesaid compromise.
Accordingly, the application is allowed. The civil second appeal stands disposed of in terms of compromise dated 06.04.2023 entered into between the parties.
The judgment and decree dated 20.08.2011 passed by the learned District Judge No.1, Sikar in Civil Regular Appeal No.81/2007 (68/2008) is quashed and set aside.
The office is directed to frame decree in terms of the compromise dated 06.04.2023.
