HON'BLE MR. JUSTICE MAHENDAR KUMAR GOYAL Judgment / Order 06/10/2023 This contempt petition has been filed alleging willful disobedience of the order of dated 02.05.2012 passed by the (Downloaded on 11/11/2023 at 08:34:21 PM) [2023:RJ-JP:27183] (2 of 2) [CCP-1090/2018] Rajasthan Civil Services Appellate Tribunal, Jaipur in Appeal No.1055/2002 whereby, while allowing the appeal preferred by the petitioner, the respondents were directed to extend the petitioner benefit of first, second and third selection scale in parity with similarly situated employees S/Shri Vishamber Singh & Shamsuddin and also to revise the pay and pension accordingly.
Learned counsel for the respondents, inviting attention of this Court towards the contents of the reply filed by them as also the documents appended therewith, would submit that when the matter was examined after passing of the order dated 02.05.2012, it transpired that S/Shri Vishamber Singh and Shamsuddin came to be extended benefit of third selection scale erroneously w.e.f. 25.01.1992 instead of 01.01.1998 and accordingly they were re-fixed in the third selection scale w.e.f. 01.01.1998 and the petitioner has also been extended benefit of third selection scale w.e.f. 01.01.1998. She, therefore, prays for dismissal of the contempt petition.
Learned counsel for the petitioner is not in a position to dispute the aforesaid statement.
In view thereof, this Court is satisfied that no contempt is made out.
Resultantly, this contempt petition is dismissed.
