1. The instant application for temporary suspension of sentence has been preferred on behalf of the appellant Prem Kumar son of Triloka Ram craving limited period's suspension of sentences so as to enable him to participate in the ensuing B.A. Part-I Examination-2023 scheduled to be held from 04.05.2023 to 12.06.2023.

2. Heard learned counsel for the appellant and learned Public Prosecutor on application for temporary suspension of sentences.

Having regard to the facts and circumstances of the case and upon perusal of the admission card of the appellant as well as the examination schedule annexed with the application for temporary (Downloaded on 01/05/2023 at 11:47:16 PM) (2 of 2) [SOSA-414/2023] suspension of sentences, this Court is of the opinion that this is a fit case for temporarily suspending the sentences awarded to the appellant so as to enable him to appear in the B.A. Part-I Examination-2023 to be conducted by the Maharaja Ganga Singh University, Bikaner.

Accordingly, this application for temporary suspension of sentence filed under Section 389 Cr.P.C. is allowed and it is ordered that the sentences passed by the learned Special Judge, POCSO Act Cases, Hanumangarh vide judgment dated 18.11.2021 in Sessions Case No.1/2019 against the appellant-applicant Prem Kumar S/o Triloka Ram, shall remain suspended till 13.06.2023 and he shall be released on temporary bail provided he executes a personal bond in the sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of the trial court. The order shall be effective from the date of the applicant's release from custody. The appellant shall surrender back before the concerned jail authority in the morning of 13.06.2023.
