1. Counsel for the applicants-petitioners is not present in the Court, reportedly on account of strike called by the Association.
2. While deprecating such practice, having regard to the fact that rights of about hundred employees is under consideration, this Court deemed it appropriate to go through the record and consider the application (I.A. No. 02/2023).
3. On perusal of the record, this Court finds that the Division Bench in its judgment dated 13.08.2021 (passed in D.B.
Special Appeal Writ No. 347/2019) had impleaded the State Government as a party respondent and submissions of Mr. Manish Vyas, the learned Additional Advocate General were taken into account, while putting seal of approval about the regularization of the petitioners - contractual employees / employees through placement agency of the University.
4. The said matter has travelled upto Hon'ble the Supreme Court and order of regularization has been affirmed.
5. Mr. Beniwal, learned counsel appearing for the University submits that regularization of these large number of employees cannot be done unless equal number of posts are sanctioned by the State Government, which according to Memorandum of Understanding between the University and the State is mandatory. It was also submitted that apart from (Downloaded on 20/03/2023 at 11:55:26 PM) [2023/RJJD/006930] (12 of 13) [WCP-308/2022] sanctioning of the posts, the requisite financial sanction/budget etc., is also required to be provided by the State Government.

Mr. Beniwal, learned counsel also submitted that the respondent - University is continuously corresponding with the State Government for requisite administrative and financial sanction, but no response has been received by the University, for which the University is not in a position to regularize the petitioners. He submitted that the application filed by the applicants - petitioners be allowed.
7. A perusal of the proceedings dated 08.12.2022 reveals that a co-ordinate Bench of this Court had observed that the grant of financial sanction is a matter between the University and the State Government.
8. Having carefully gone through the record, including the Division Bench judgments dated 13.08.2021 (passed in D.B.
Special Appeal Writ No. 347/2019) and 22.11.2005 passed by this Court in D.B. Civil Writ Petition No. 4114/2000, and considering that the present application has been filed after the proceedings dated 08.12.2022, this Court deems it appropriate to allow the application seeking impleadment, so that the due compliance be ensured.
9. For the reasons stated above, the application is allowed.
10. The persons mentioned in Para-7 of the application being the persons holding posts of Principal Secretary, Department of Higher & Technical Education, Government of Rajasthan, Secretariat, Jaipur, Rajasthan and Joint Secretary (Group-4), Department of Higher & Technical Education, Government of (Downloaded on 20/03/2023 at 11:55:26 PM) [2023/RJJD/006930] (13 of 13) [WCP-308/2022] Rajasthan, Secretariat, Jaipur, Rajasthan are hereby impleaded as party respondents.
11. Amended cause title filed alongwith the application is taken on record. The same be placed appropriately.
12. Issue notice to the newly arrayed respondent nos. 2 and 3, returnable on 21.04.2023.
13. List all these cases on 21.04.2023.
14. It will be open for the Registrar of University to send a copy of this order to the respondent nos. 2 and 3 while pursuing for University's request for issuing administrative and financial sanction.
