JUSTICE VINIT KUMAR MATHUR Order 24/01/2023 Learned counsel for the petitioner submits that the controversy involved in the present case is squarely covered by the judgment dated 23.10.2021 passed by this Court in the bunch of writ petitions led by Surender Kaur Memorial College of Higher Education Vs. State of Rajasthan & Ors., S.B. Civil Writ Petition No.2359/2021 as well as the judgment dated 11.01.2022 passed by this Court in S.B. Civil Writ Petition No.529/2022, Shree S.r. Shikshak Prashikshan Mahavidhalaya, Bhainsawa Vs. State of Rajasthan & Ors.
Learned counsel for the petitioner submits that the petitioner may be permitted to file a representation before the respondent No.2 and the respondent No.2 may be directed to decide the same (Downloaded on 24/01/2023 at 11:38:39 PM) [2023/RJJD/002034] (2 of 2) [CW-18174/2022] expeditiously. He further submits that the judgments passed by this Court on 23.10.2021 and 11.01.2022 may also be considered by the respondent No.2 while disposing of the representation.
In view of the limited prayer made by the learned counsel for the petitioner, the petitioner may prefer a representation to the respondent No.2 along with the copy of the judgment dated 23.10.2021 passed in the case of Surender Kaur Memorial College of Higher Education (supra) as well as the copy of the judgment dated 11.01.2022 passed in the case of Shree S.r. Shikshak Prashikshan Mahavidhalaya, Bhainsawa (supra), and the respondent No.2 shall decide the same strictly in accordance with law. While deciding the representation of the petitioner, the respondent No.2 shall also take into consideration the judgments dated 23.10.2021 and 11.01.2022 and decide the said representation expeditiously preferably within a period of six weeks from the date of receipt of such representation.
The present writ petition is disposed of in the above terms.
