HON'BLE MR. JUSTICE SUDESH BANSAL Order 25/01/2023 Counsel for petitioners states that petitioners have acquired the required qualification from the National Institute of Open Schooling (NIOS) and in case of Jitendra Sharma & Ors. Vs. State of Rajasthan & Ors., SB Civil Writ Petition No.11705/2015 and other connected petitions decided on 20.4.2018, the Coordinate Bench of this Court has decided that candidates who have completed their studies from the National Institute of Open Schooling are eligible for registration before the Rajasthan Para-Medical Council. The judgment of learned Single Judge has been affirmed by the Division Bench of this Court and further the Special Leave Petition filed by the State has also been dismissed by the Apex Court. Counsel for petitioners states that application form of petitioners for registration is pending before the Rajasthan Para-Medical Council and registration of few other similarly situated candidates has been made. It has been stated that meanwhile advertisement dated 15.12.2022 has been issued (Downloaded on 26/01/2023 at 12:09:16 AM) (2 of 2) [CW-1309/2023] by the State Government advertising vacancies for the Lab Technician wherein petitioners are eligible to participate but on account of delay on the part of respondent- Para-Medical Council, they are deprived to fill their online application form.

Issue notice to respondents.
Taking into consideration the aforesaid contention, respondents are directed to allow petitioners to submit their offline application form for the post of Lab Technician provisionally, subject to outcome of this writ petition. However, result of petitioners shall not be disclosed without prior permission of this Court.
