JUSTICE FARJAND ALI Order 02/01/2023 The appeal is reported to be filed belatedly and an application under Section 5 of the Limitation Act has been preferred averring therein that the appellant is languishing in jail and there is no other person to pursue the case or to assist him for legal remedies, therefore was was abstained to file appeal within stipulated period.
Heard on the application filed under Section 5 of the Limitation Act.
For the reasons and grounds mentioned therein, and considering the fact that the appellant was behind the bars and this appeal is against the judgment of conviction and order of sentence whereby he has been convicted and sentenced to suffer 10 years of imprisonment, it is deemed appropriate to allow the application.
Accordingly, the application for condonation of delay is allowed. The appeal be treated within limitation.
