Learned counsel for the petitioner has preferred the present writ petition with the following prayer:-
'It is therefore most respectfully prayed that in view of the submissions made hereinabove, the present Second Stay application filed by the petitioner may kindly be allowed and pending final hearing and disposal of the writ petition S.B.C.W.P. No.1421/2015, respondents may kindly be directed to give appointment to the petitioner on the post of (Downloaded on 10/01/2023 at 11:29:02 PM) (2 of 2) [CW-1421/2015] Anganwari Worker in pursuance of the Circular dated 19.08.2021 (Annex.01) issued by the Women and Child Development Department, Govt. of Raj., Jaipur.' Learned counsel for the petitioner submits that the petitioner applied against the post of Aanganwari Worker in the Aanganwari Kendra, Ralda, Gram Panchayat Mathugamada Khas. However, she was denied appointment in contravention of the circular dated 06.08.2014, issued by the Department of Women and Child Development Deparment, Govt. of Rajasthan dealing with the appointments of Aanganwari Workers.
Learned counsel for the respondents submit that during the pendency of the writ petition, the circular dated 06.08.2014, issued by the Department of Women and Child Development Deparment, Govt. of Rajasthan, has been superseded by circulars dated 09.11.2016 and 19.08.2021. Therefore, the relief claim in the present writ petition cannot be granted in favour of the petitioner.
Learned counsel for the petitioner is not in a position to refute the aforesaid factum regarding issuance of circulars dated 09.11.2016 and 19.08.2021 and therefore, nothing remains to be adjudicated upon in the present writ petition.
Accordingly, the present writ petition is dismissed as having rendered infructuous with the efflux of time.
Stay application also stands disposed of accordingly.
