1. Learned counsel for the petitioners submits that the petitioner would feel satisfied if a direction is issued to the respondents to decide their representation dispassionately in the light of the judgments dated 08.02.2012 rendered in the case of Ashok Kumar Baser Vs. State of Rajasthan & Ors. (SBCWP No.6707/2007) and dated 10.07.2017 rendered in the case of Om (Downloaded on 02/01/2023 at 08:39:13 PM) (2 of 2) [CW-18941/2022] Prakash Beniwal Vs. State of Rajasthan & Anr. (SBCWP No.8204/2014).
2. In view of the aforesaid, the present writ petition is disposed of with the direction to the respondents to decide petitioners' representation in the light of the judgments passed by this Court in the cases of Ashok Kumar Baser (supra) and Om Prakash Beniwal (supra).
3. For the purpose aforesaid, the petitioners may file a fresh representation alongwith all relevant material including copies of the judgments aforesaid alongwith certified copy of the order instant, within a period of two weeks from today. The respondents are directed to consider petitioners' representation in accordance with law, within a period of four weeks thereafter.
4. It is made clear that aforesaid direction to decide the petitioners' representation has been issued only with a view to ensure expeditious redressal of petitioners' grievance. The same may not be construed to be an order to decide the representation in a particular manner.
5. The stay application also stands disposed of accordingly.
