HON'BLE MR. JUSTICE ASHOK KUMAR GAUR Order 31/01/2023 Learned Senior Counsel for the respondent-Bank Mr.R.K. Mathur submitted that an application has been filed for dismissing the writ petition as the present writ petition is not maintainable under Article 226 of the Constitution of India before this Court.
Learned Senior Counsel for the respondents has also made reference of judgment passed by the Larger Bench as well as several judgments passed by the Division Bench and Single Bench.
Learned counsel for the petitioner Mr.Vigyan Shah submitted that some time may be granted to satisfy this Court (Downloaded on 02/02/2023 at 12:28:05 AM) [2023/RJJP/001054] (2 of 2) [CW-779/2020] with regard to availability of jurisdiction under Article 226 of the Constitution of India in respect of service conditions being violated by employees working in private Bank.
Learned counsel is free to do so. List on 15.02.2023.
