Delay in filing appeal (SAW No.1226/2019), for the reasons indicated in the application under Section 5 of the Limitation Act, is condoned.
Learned counsel for the parties submit that the issue raised in the present special appeals is squarely covered by order in DBSAW No.173/2019 : Rajasthan State Industrial Development & Investment Corporation Ltd. & Anr. v. Jawari Lal Jain & Ors. and other connected matters, decided on 06.07.2022, whereby the judgment of the learned Single Judge has been set-aside and the writ petitions preferred by the writ petitioners were dismissed and therefore, the present special appeals may also be allowed and the order of the learned Single Judge be set-aside.
In view of the submissions made, the special appeals are allowed. The order dated 14.05.2018 passed by the learned Single Judge is set-aside. The writ petitions preferred by the respondents-writ petitioners are dismissed.
No order as to costs.
