Learned counsel for the appellant submits that the respondent no.1/6 expired during the pendency of the first appeal for which, appellant had already filed an application before the appellate court in this regard. However, in final judgment, legal representative of respondent No.1/6 were not shown.
Looking to the reasons mentioned by the appellant in the application, the same is allowed. Defect No.2 is overruled.
Learned counsel for the appellant submits that he has already filed court fees which may be taken on record.
Learned counsel for the appellant seeks two weeks' time to remove the defect No.5.
Defects may be positively removed within a period of two weeks.
