The present bail application has been filed under Section 438 Cr.P.C. on behalf of the accused-petitioner Shyonath Meena S/o Shri Kalyan Sahay Meena in connection with FIR No.194/2019 registered at Police Station Gandhi Nagar, Jaipur City (East) for the offence(s) under Sections 420, 467, 468, 471 & 406 IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in this case. The allegations leveled in the FIR are patently false.

Learned Public Prosecutor has vehemently opposed the bail application.

Heard learned counsel for the petitioner, learned Public Prosecutor and perused the F.I.R. impugned and the other material available on record. Considering the peculiar facts and circumstances of this case and looking to the allegation that a (Downloaded on 22/03/2022 at 09:36:04 PM) (2 of 2) [CRLMB-8242/2021] negative final report came to be submitted after investigation and the matter is again being investigated under order of the Judicial Magistrate, this court deems it just and proper to allow the anticipatory bail application.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Gandhi Nagar, Jaipur City (East) in F.I.R. No. 194/2019 is directed that in the event of arrest of the petitioner- Shyonath Meena S/o Shri Kalyan Sahay Meena he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;
(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and
(iii) that the petitioner shall not leave India without previous permission of the court.
