Order 14/06/2022 Petitioner has challenged the impugned judgment dated 23.05.2022 passed by Additional District & Session Judge No.9, Jaipur Metropolitan, Jaipur in criminal appeal No.15/2018 (248/2018) by which he maintained the judgment and order dated 08.02.2018 passed by the court of Additional Chief Metropolitan Magistrate (Communal Rights), Jaipur Metropolitan Jaipur in criminal case No.326/2016 convicting the petitioner for offence under Section 3/25 Arms Act and awarding sentence of one year rigorous imprisonment with fine of Rs.1,000/- and in default of non-payment of fine further simple imprisonment of three months. (2 of 2) Heard learned counsel for accused-petitioner as well as learned Public Prosecutor and perused the material available on record.
Considering the facts and circumstances of the case, nature of the offence, punishment and the fact that the petitioner is in custody since 23.05.2022, but without commenting on merits of the case; this Court deems it just and proper to suspend the sentence of imprisonment awarded to the accused-petitioner during course of hearing this petition.
Accordingly, in case petitioner deposits fine of Rs.1000/- as directed by the court below within a period of two weeks from today, the sentence of the petitioner shall remain suspended, the application for suspension of sentence is allowed and it is ordered that the accused-petitioner-Rajendra Kumar Sharma Son Of Shri Ramswaroop Sharma shall be released on bail provided he executes a personal bond in the sum of Rs.50,000/- along with two sureties of Rs.25,000/- each to the satisfaction of the trial court for his appearance in this court on 18.07.2022 and as and when called upon to do so.
