HON'BLE DR. JUSTICE PUSHPENDRA SINGH BHATI Order 14/01/2022 In wake of instant surge in COVID-19 cases and spread of its highly infectious Omicron variant, lawyers have been advised to refrain from coming to the Courts.
Learned counsel for the petitioner has drawn attention of this Court towards the judgment passed by a Co-ordinate Bench of this Court in Naina Ahari Vs. State of Rajasthan & Ors (SBCWP No.102/2022) decided on 06.01.2022 and learned counsel for (Downloaded on 17/01/2022 at 08:47:14 PM) (2 of 2) [CW-745/2022] the petitioner seeks same relief / directions as granted in the case of Naina Ahari (supra).
In view of the submissions made, the writ petition filed by the petitioner is disposed of with the similar directions as given in the case of Naina Ahari (supra), which read as under:-
"It is submitted by the counsel for the petitioner that qua the posting order dated 05.08.2020 the petitioner has made representation to the respondents seeking transfer as per order dated 30.07.2021, which order has subsequently been stayed, however, qua certain other persons, the same has been implemented and, therefore, the respondents be directed to decide the pending representation of the petitioner.
In view of submissions made, the petition filed by the petitioner is disposed of; the petitioner may make a fresh detailed representation to the respondent No.2 within a period of one week. In case such a representation is made by the petitioner, the same shall be deal with appropriately expeditiously and an order on the same be passed by the said authority within a period of two weeks from the date filing of representation."
All pending applications also stand disposed of accordingly.
