HON'BLE MR. JUSTICE FARJAND ALI Judgment / Order 04/02/2022 By way of filing instant miscellaneous petition, challenge has been made to the order dated 01.10.2019, whereby, the prayer of the petitioner to send the matter for registration of the FIR, has been declined and the learned Magistrate deemed appropriate to send the matter for enquiry under Section 202 of the Cr.p.c. to the Station House Officer, Police Station Jyoti Nagar, Jaipur (South).

Looking to the totality of the facts and circumstances of the case, learned Magistrate has not committed any error in passing the order and, therefore, the petition deserves to be dismissed.

Accordingly, the criminal miscellaneous petition is dismissed. Stay application is also dismissed.
