Learned counsel for the petitioner has opposed the aforesaid application.
Having heard learned counsel for the parties and taking into consideration the fact that the petitioner has been removed from the post of Chairman of the Water User Association on a complaint filed by the applicant claiming that since the petitioner is not qualified to be elected as a Chairman on account of having (Downloaded on 09/12/2022 at 11:53:21 PM) (2 of 2) [CW-17723/2022] disqualification, this Court is of the view that the applicant is required to be impleaded as party respondent in this writ petition.
Hence, the aforesaid application is allowed. The applicant - Rakesh Kumar is impleaded as party respondent No.5 in this writ petition.
Learned counsel for the petitioner may file amended cause title during the course of the day.
Reply on behalf of the respondent - State has already been filed, however, the same is not available on record.
Office is directed to place the reply filed on behalf of the respondent - State on record.
