HON'BLE THE CHIEF JUSTICE MR. AKIL KURESHI HON'BLE MR. JUSTICE SANDEEP MEHTA Order 18/10/2021 This appeal is directed against the judgment of the learned Single Judge dated 26.11.2020 in CWP No.11589/2020.
Learned counsel for the appellant State of Rajasthan submitted that the learned Single Judge has relied upon the decision of this Court in case of Shree Gopal Gour vs. State of Rajasthan (CWP No.11839/2016, decided on 13.04.2018), in which the Pension Rule applicable was different from Rule 10 (Downloaded on 18/10/2021 at 08:27:22 PM) (2 of 2) [SAW-546/2021] of the Rajasthan Municipal Service (Pension) Rules, 1989 applicable to the petitioner herein.
Issue notice, returnable on 26.11.2021.
By way of an interim relief, the impugned judgment of the learned Single Judge is stayed.
