JUSTICE VINIT KUMAR MATHUR Order 18/11/2021 Learned counsel for the petitioner submits that the offence alleged under Juvenile Justice (Care and Protection of Children) Act 2015 is not made out, in view of the judgment of Kerala High Court in the case of A. Nizamudin vs. The Station House Officer Kannur Town Station (Criminal Misc. Case No. 588 of 2017) dated 30.05.2017 and in view of the judgment dated 12.07.2017 passed by this Court in the case of Natthuram vs. State of Rajasthan (S.B. Criminal Misc. Bail No. 9030 of 2017).

Learned Public Prosecutor submits that the evidence or record shows that the petitioner is the owner of the Brick kilns factory, where the children were found working in the factory premises (Brick Kilns).

In these circumstances, learned Public Prosecutor is directed to call for the case diary on the next date of hearing. (Downloaded on 18/11/2021 at 09:08:09 PM)

Meanwhile and till the next date of hearing, the petitioner shall not be arrested in connection with the F.I.R. No. 169/2021 Police Station Baneda, District Bhilwara. However, the petitioner shall join the investigation and appear before the Investigating Officer as and when called upon to do so.
