1. Through the instant writ petition(s), cast under Article 226 of the Constitution of India, prayer is made for issuance of a mandamus,, upon the respondents No.2 and 3, to consider and decide the application(s) dated 04.11.2019 (Annexure P-2), P respectively, for grant of stage carriage permit for a small size bus on the rural route, i.e. Dhuri to Barnala, in accordance with MANPREET SINGH 2026.05.26 17:29 Chapter V of the Motor Vehicle Act, 1988 read with Clause 3E of the Punjab I attest to the accuracy and authenticity of this order/judgment CWP-16228 16228-2026 2026 and 2 CWP-16346 16346-2026 Transport Scheme, 2018/2019, 2018/2019, which is pending adjudication, des despite the legal notice dated 05.05.2026 (Annexure P-4) P 4), duly served.
2. Notice of motion.
3. Mr. Sahil R. Bakshi, AAG, Punjab, accepts notice on behalf of the respondents/State, and waives services. On instructions imparted to him from Dr. Poonampreet Kaur, PCS, Secretary, Regional Transport Authority, Patiala, submits that he has no objection, in case, a mandamus is passed upon the authorities uthorities concerned, to decide the legal notice (supra).
4. In view of the above, since a bona fide and innocuous prayer has been made by the petitioner, petitioner this Court deems it fit and appropriate to pass a mandamus upon the respondents respondent No.2 and 33, to decide the legal notice dated 05.05.2026 (Annexure P-4), P after providing iding due opportunity of hearing to the petitioners.
5. The exercise (supra), shall be carried out within a period of eight weeks, from the date of receipt of certified copy of this order.
6. Disposed of accordingly.
7. Copy of this order be conveyed to the respondents No.2 and 3, 3 forthwith, for its compliance.
8. Photocopy of this order be placed on the connected case file.
