1. The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 16.10.2023 (Annexure P-13) as well as letter dated 30.05.2022 (Annexure P-9) whereby respondents have cancelled his Scheduled Caste Certificate dated 07.06.1993.

2. The petitioner was issued Scheduled Caste Certificate on 07.06.1993. As per said Certificate, petitioner belongs to Sirkiband Community. He was appointed as Peon in the Education Department under PWD Quota. He was promoted as Clerk in 2013. State of Punjab on 15.07.2019 issued instructions regarding issuance and verification of SC/BC/OBC Castes Certificates. Tehsildar, Patiala vide order dated 30.05.2022 recommended cancellation of petitioner's Caste Certificate. State Level Scrutiny Committee in its meeting dated 24.08.2022 recommended MOHIT KUMAR cancellation of petitioner's Caste Certificate. Patiala appointed Inquiry Officer to conduct preliminary inquiry regarding petitioner's Caste Certificate. The Inquiry Officer vide report dated 18.05.2023 found that petitioner was appointed under PWD Quota and not under SC Quota. Sub-Divisional Magistrate, Patiala by order dated 16.10.2023 cancelled his Caste Certificate. FIR No.42 dated 30.03.2025 under Sections 420, 465, 467, 468, 471 and 120-B of Indian Penal Code, 1860 at Police Station Sadar, Patiala has been registered against him alleging preparation/use of false Caste Certificate. He was granted anticipatory bail by learned Additional Sessions Judge, Patiala vide order dated 04.06.2025. District Social Justice and Empowerment Officer, Patiala has issued communication dated 29.09.2025 acknowledging difficulties and contradiction in the verification of Sirkiband and ODH Caste claims and recommended ethnological and anthropological study.

3. After arguing for some time, learned counsel for the petitioner seeks permission to withdraw the petition with liberty to avail remedies as permissible by law.

4. Dismissed as withdrawn with aforesaid liberty.
