1. This order shall dispose of the above above-mentioned mentioned writ petitions as they arise from a similar factual matrix. However, for the sake of brevity, the facts are taken from CWP-31278-2025.

2. The present ent petition(s) have been filed under Articles 226/227 of the Constitution of India praying for issuance of a writ in the nature of mandamus directing the respondent to make payment of balance amount of gratuity payable in accordance with Revised Gratuity upon Amendment in the Payment of Gratuity Act, 1972 thereby enhancing the maximum limit of gratuity from existing Rs.10 lakh to Rs.20 lakh w w.e.f.

.e.f. 29.03.2018 along with interest @ 9% per annum.

3. On 17.10.2025, the following order was passed:

"The The present petition(s) has been filed under Article 226 of the Constitution of India for issuance of a writ, order or direction in the nature of mandamus ndamus directing the respondent to make payment of balance amount of Gratuity payable in accordance with Revised Gratuity upon amendment in the Payment of Gratuity Act, 1972 thereby enhancing the maximum limit of gratuity from existing Rs.10 lakhs to Rs.20 lakhs w.e.f. 29.03.2018 along with interest @ 9% p.a. Learned counsel for the petitioners inter alia submits that denying the case of the petitioner(s) in enhancing the gratuity is in violation of instructions issued by Government of Punjab and their case se is squarely covered by the judgments rendered by coordinate Bench of this Hon'ble Court in CWP-

During the course of hearing, learned counsel appearing for the respondents could not dispute dispute the fact that the controversy involved in the present writ petition(s) is squarely covered by the judgments rendered by the Coordinate Bench of this Court in Yadbinder Pal Singh (supra) and Som Nath (supra).

5. In view of the above and without entering into any further detailed adjudication, this Court is of the considered opinion that the issue involved in the present writ petition(s) is no longer res integra and stands conclusively settled by the aforesaid judgments.

6. Accordingly, the present nt writ petition(s) are disposed of in terms of the judgments passed in Yadbinder Pal Singh (Annexure P-5) and Som Nath (Annexure P-6).. The respondents are directed to recalculate the gratuity payable to the petitioner(s) in accordance with the revised ceiling ling prescribed under the amended provisions of the Payment of Gratuity Act, 1972,, and to release the balance amount of gratuity to the petitioner(s) within a period of three months from the date of receipt of a certified copy 3 of 4 ::: Downloaded on - 07-03-2026 07:28:08 ::: 4 CWP-31278 31278-2025 & CWP-34335-2025 of this order. The respondents respondents shall also ensure that the arrears of the balance gratuity amount are paid along with interest @ 6% per annum, annum calculated from the date the said amount became due till the date of its actual realization.

7. Pending miscellaneous application(s), if any, shall also stand disposed of.

8. Registry is directed to place a photocopy of this order on the paper-books books of the connected matters.
