1. Petitioner seeks quashing of FIR No. 9 dated 29.01.2022 under Sections 323, 406, 498-A and 506 Indian Penal Code, Women Police Station Kaithal, District Kaithal and all subsequent proceedings arising therefrom, on the basis of compromise dated 03.09.2025. Sections 354, 354-A and 34 IPC were deleted from the FIR during investigation.
2. On 20.02.2026 and 19.03.2026, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements on the basis of compromise dated 03.09.2025.
3. In compliance of the aforesaid order, parties appeared before learned JMIC, Kaithal on 25.03.2026. Statement of Investigating Officer HC Geeta was recorded on 06.04.2026. Learned JMIC, Kaithal has submitted SUMIT SINGLA 2026.04.24 18:15 I attest to the accuracy and integrity of this document CRM-M-9870-2026 (O&M) -2- her report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. Point-wise report as under

"POINT NO.1:
Regarding Point No. (1), it is submitted that as per the statement of Investigating Officer HC Geeta Belt No.16/KTL, posted at Police Station Sadar, Kaithal (Annexure-3), there are total four accused persons namely Sandeep Kumar, Rajinder Singh, Sheela Devi & Pardeep Kumar are arraigned as accused in the FIR. However, challan was presented against only one accused namely Sandeep Kumar.
POINT NO.2:
Regarding Point No. (2), it is submitted that there is only one accused namely Sandeep Kumar & he has appeared before the Court and made his statement (Annexure-2). POINT NO.3:
Regarding point No.(3), it is submitted as per the statement of Investigating Officer HC Geeta Belt No.16/KTL, posted at Police Station Sadar, Kaithal (Annexure-3), no additional accused has been added during investigation. POINT No.4 Regarding point No.(4), it is submitted as per the statement of Investigating Officer HC Geeta Belt No.16/KTL, posted at Police Station Sadar, Kaithal (Annexure-3), none of the SUMIT SINGLA 2026.04.24 18:15 I attest to the accuracy and integrity of this document CRM-M-9870-2026 (O&M) -3- accused is absconder or proclaimed offender. POINT No.5 Regarding point No.(5), it is submitted as per the statement of Investigating Officer HC Geeta Belt No.16/KTL, posted at Police Station Sadar, Kaithal (Annexure-3), sections 354, 354-A and 34 IPC were deleted during investigation. POINT No.6 Regarding point No.(6), it is submitted as per the statement of Investigating Officer HC Geeta Belt No.16/KTL, posted at Police Station Sadar, Kaithal (Annexure-3), challan was presented only against accused Sandeep Kumar and remaining three accused namely Rajinder Singh, Sheela Devi and Pardeep Kumar were found innocent. No investigation is pending against them.
POINT No.7 Regarding point No.(7), it is submitted that name of the complainant/injured/aggrieved is Rajni daughter of Ramkaran, resident of Village Barot, Tehsil and District Kaithal. POINT No.8 Regarding point No.(8), it is submitted that complainant Rajni has appeared before the Court and her statement has been duly recorded (Annexure-1).
POINT NO.9 Regarding Point No.(9), it is submitted that the Investigating SUMIT SINGLA 2026.04.24 18:15 I attest to the accuracy and integrity of this document CRM-M-9870-2026 (O&M) -4- officer HC Geeta Belt No.16/KTL, posted at Police Station Sadar, Kaithal appeared before the Court and her statement has been recorded (Annexure-3).
POINT NO.10 Regarding Point No.(10), it is submitted that the case is at the stage of prosecution evidence.
POINT NO.11 Regarding Point No.(11), it is submitted that complainant Rajni daughter of Ramkaran, resident of Village Barot, Tehsil and District Kaithal, vide separately recorded statement has stated that compromise has been effected between the parties out of their free will and without any coercion or pressure from any corner. Statement of complainant/victim is (Annexure-1). She has stated that she has no objection if FIR is quashed. Accused Sandeep Kumar, son of Rajinder Singh, resident of village Matur, Tehsil Kalayat, District Kaithal has also stated that compromise is correct and genuine and is effected out of free will of the parties, without any pressure or coercion. Separate statement of accused is recorded in this regard (Annexure-2). In view of the said statements of the parties, the compromise appears to have been effected voluntarily and out of the free will. It is submitted that the compromise effected between the parties is genuine. POINT NO.11 Regarding point No.(12), it is submitted as per the SUMIT SINGLA statement of Investigating Officer HC Geeta Belt No.16/KTL, 2026.04.24 18:15 I attest to the accuracy and integrity of this document CRM-M-9870-2026 (O&M) -5- posted at Police Station Sadar, Kaithal (Annexure-3), no other criminal case or proceedings is pending against accused Sandeep Kumar."
4. Learned State counsel and learned counsel for respondent No.2 have not raised any dispute regarding the factum of compromise between petitioner and respondent no.2.
5. Since the matter has been amicably settled between the parties, continuation of the criminal proceedings would be an exercise in futility. The dispute which has its genesis in a matrimonial discord, warrants exercise of powers under Section 528 BNSS.
6. Following principles of law laid down by the Full Bench Judgment of this Court in "Kulwinder Singh and others Vs. State of Punjab and another" 2007(3) RCR (Criminal) 1052 and Hon'ble Supreme Court in "Gian Singh Versus State of Punjab and others" (2012) 10 SCC 303, the petition is allowed.
7. FIR No. 9 dated 29.01.2022 under Sections 323, 406, 498-A and 506 Indian Penal Code, Women Police Station Kaithal, District Kaithal and all consequential proceedings arising therefrom, are quashed qua the petitioner.
8. Pending miscellaneous applications, if any, stand disposed of.
