Petitioner seeks quashing of FIR No. No.163 dated 25.07.2024,, under Sections Section 74, 79, 326(g), 324(4), 115(2) and 296 of BNS, Police Station City Jagraon, Jag District Ludhiana, and all subsequent proceedings arising therefrom, on the basis of compromise dated 05.03.2026 said to be arrived at between the parties.
2. On 19.03.2026,, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements with regard to compromise.
3. In compliance of the aforesaid order, parties appeared before learned Sub Divisional Judicial Magistrate, Jagraon Jagraon, on 25.03.2026..
Statement tement of Investigating officer- ASI Balwinder Singh, No.667/LDH(R), KAPIL posted at Police Station City Jagraon, Jagraon was recorded on 02.04.2026.. Learned 2026.04.23 19:35 I attest to the accuracy and integrity of this document 15080-2026 (O&M) CRM-M-15080 M) 2 Sub Divisional Judicial Magistrate, Jagraon Jagraon, has submitted her report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. The relevant part of the report as under has been submitted:
"1. As per statement of parties and investigating officer, there is only ly one accused namely Vipan Kumar arraigned in the FIR
2. As per the statement of parties and investigating officer, accused namely Vipan Kumar appeared and made his statement before the Trial Court.
3. As per statement of investigating officer, there is no additional accused has been added and he/she is a party to the compromise.
4. As per statement of investigating officer, accused has not been declared as Proclaimed Offender.
5. As per statement of investigating officer, after the registration of the FIR, no other offence was added or deleted during investigation.
6. As per statement of investigating officer, No other investigation is pending against accused.
7. As per statement off parties and investigating officer, there is only one complainant namely Darshan Kumar Dhand and injured/aggrieved and three victims namely Satish Kumar, Kuldeep Singh and Pooja Rani, in the present FIR
8. As per statement of parties and investigating of official, ficial, all the injured/aggrieved have appeared and made their statement in support of the compromise.
9. As per statement of parties and investigating officer, the stage of trial/proceedings is prosecution evidence.

11. As per the statement of investigating officer, no other criminal case or proceedings is pending against the accused.

4. Learned State counsel and learned counsel for respondent respondents No.2 to 5 have not raised any dispute regarding the factum of com compromise.
promise. Since the matter has been amicably resolved, continuation of the criminal proceedings would be an exercise in futility.
5. Following principles of law laid down by the Full Bench Judgment of this Court in "Kulwinder Singh and others Vs. State ooff Punjab and another" 2007(3) RCR (Criminal) 1052 and Hon'ble Supreme Court in "Gian Singh Versus State of Punjab and others" (2012) 10 SCC 303,, the petition is allowed.
6. Consequently, FIR No.163 dated 25.07.2024, under Sections 74, 79, 326(g), 324(4), 115(2) and 296 of BNS, Police Station City Jagraon, District Ludhiana, Ludhiana and all consequential proceedings arising therefrom, are quashed qua the petitioner, on the basis of compromise date dated 05.03.2026.
7. Pending applications, if any, stand disposed of.
