1. Petitioners seek quashing of FIR No.0096 dated 28.08.2023 under Sections 406, 498-A Indian Penal Code, Police Station City 2 Abohar, District Fazilka and all consequential proceedings arising therefrom, on the basis of compromise dated 18.08.2025. This is the second petition for quashing of FIR. First one was dismissed as withdrawn on 01.08.2024.
2. On 19.02.2026 and 17.03.2026, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements on the basis of compromise dated 18.08.2025.
3. In compliance of the aforesaid order, parties appeared before learned JMIC, Abohar on 06.04.2026. Statement of Investigating Officer SI Aadil Sama was also recorded on 06.04.2026. Learned JMIC, Abohar has SUMIT SINGLA 2026.04.22 19:11 I attest to the accuracy and integrity of this document CRM-M-9218-2026 (O&M) -2- submitted his report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. Point-wise report as under has been submitted:
"i. It is submitted that as per statement of Investigating Officer, there are total four person arrayed as accused in present FIR.
ii. It is submitted that all the above said accused persons have appeared before the Court of undersigned and made their statements.
iii It is further submitted that as per statement of Investigating Officer, during investigation, no additional accused has been added in present case and therefore no other person is a party to the compromise in present case.
iv. It is further submitted that as per statement of Investigating Officer, above named accused have not been declared absconding/ proclaimed persons in this case. v. It is further submitted that as per statement of Investigating Officer, after the registration of the FIR, no offence was added or deleted during investigation. vi. It is further submitted that as per statement of investigating officer, investigation is not pending against any accused and therefore no accused has been declared as innocent. vii. It is submitted that as per statement of Investigating Officer, there is only one complainant/injured/aggrieved namely SUMIT SINGLA Sonia wife of Prince Kumar in present FIR. It is further submitted 2026.04.22 19:11 I attest to the accuracy and integrity of this document CRM-M-9218-2026 (O&M) -3- that as per statement of investigation officer, there is no other injured/aggrieved person in present case. viii. It is submitted that complainant namely Sonia wife of Prince Kumar has appeared before the Court of undersigned and made her statement in support of compromise. ix. It is submitted that as per statement of Investigating Officer, the challan of the present case has been presented against the above said accused persons before the Court and the charge has been framed upon the said accused and now the trial of present case is pending for prosecution evidence. x. It is further submitted that in view of the statements got recorded by both the parties, this Court is satisfied that the compromise effected between them is genuine, voluntary and out of free will of the parties.
xi. It is further submitted that as per statement of Investigating Officer, no any other criminal case or proceedings is pending against the above said accused persons. xii. It is further submitted that the investigating officer namely SI Aadil Sama, 3525/PBI, PS City-II Abohar has appeared and recorded his statement."
4. Learned State counsel and learned counsel for respondent No.2 have not raised any dispute regarding the factum of compromise between petitioners and respondent no.2.

Since the matter has been amicably settled between the parties, SUMIT SINGLA 2026.04.22 19:11 I attest to the accuracy and integrity of this document CRM-M-9218-2026 (O&M) -4- continuation of the criminal proceedings would be an exercise in futility. The dispute which has its genesis in a matrimonial discord, warrants exercise of powers under Section 528 BNSS.
6. Following principles of law laid down by the Full Bench Judgment of this Court in "Kulwinder Singh and others Vs. State of Punjab and another" 2007(3) RCR (Criminal) 1052 and Hon'ble Supreme Court in "Gian Singh Versus State of Punjab and others" (2012) 10 SCC 303, the petition is allowed.
7. FIR No.0096 dated 28.08.2023 under Sections 406, 498-A Indian Penal Code, Police Station City 2 Abohar, District Fazilka and all consequential proceedings arising therefrom, are quashed qua the petitioners.
8. Pending miscellaneous applications, if any, stand disposed of.
