1. Petitioner seeks quashing of FIR No.26 dated 02.04.2025 under Sections 498-A, 495 Indian Penal Code, Police Station Women Cell, District Jalandhar Police Commissionerate and all consequential proceedings arising therefrom, on the basis of compromise dated 19.11.2025.
2. On 19.02.2026 and 18.03.2026, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements on the basis of compromise dated 19.11.2025.
3. In compliance of the aforesaid order, parties appeared before learned JMIC, Jalandhar on 25.03.2026. Statement of Investigating Officer ASI Tarsem Kaur was also recorded on 25.03.2026. Learned JMIC, Jalandhar has submitted her report recording satisfaction that all the parties have entered into a valid compromise without any influence or coercion. CRM-M-67680-2025 (O&M) -2- Point-wise report as under has been submitted:
"1. It is respectfully submitted that in compliance to the directions issued by the Hon'ble Punjab and Haryana High Court, vide order dated 19.02.2026 and 18.03.2026, passed in CRM-M- 67680 of 2025, statements of complainant Taj Bibi, D/o Sh. Bashir Hussain, resident of Patti Barri Ki, Village Jaindiala, Tehsil Phillar, Distt Jalandhar, accused Aslam Khan son of Sh. Anwar Hussian, Resident of Borcherting 90, 22309, Hamburg, Germany at present r/o Village Mauli, Tehsil Phagwara, Distt Kapurthala and Investigating Officer ASI Tarsem Kaur, No.493, posted at PS Women Cell, Jalandhar recorded by theundersigned. The parties were duly identified by their respective counsels and IO.
2. Complainant Taj Bibi, D/o Sh. Bashir Hussain, resident of Patti Barri Ki, Village Jaindiala, Tehsil Phillar, Distt Jalandhar suffered statement to the effect that she is the complainant in the present FIR no. 26 dated 02.04.2025, under Section 498-A, 495 IPC, P.S. Women Cell, Jalandhar. She has compromised the matter with the accused Aslam Khan son of Sh. Anwar Hussian, Resident of Borcherting 90, 22309, Hamburg, Germany at present r/o Village Mauli, Tehsil Phagwara, Distt Kapurthala in FIR no. 26 dated 02.04.2025, under Section 498-A, 495 IPC, P.S. Women Cell, Jalandhar with the intervention of respectable persons. She has entered into compromise without any pressure, coercion and undue influence vide compromise deed dated 19.11.2025, photocopy of which is Ex. P1. She is the only SUMIT SINGLA complainant/injured/aggrieved person in the present case. She has no objection if the present FIR is quashed against the accused Aslam Khan. The quashing petition may kindly be accepted in view of the terms and conditions of the compromise and above mentioned FIR and other consequential proceedings may kindly be quashed.
3. Similarly, the statement of accused namely Aslam Khan son of Sh. Anwar Hussian, Resident of Borcherting 90, 22309, Hamburg, Germany at present r/o Village Mauli, Tehsil Phagwara, Distt Kapurthala was also recorded, wherein he has stated that he has compromised the matter with the complainant Taj Bibi, D/o Sh. Bashir Hussain, resident of Patti Barri Ki, Village Jaindiala, Tehsil Phillar, Distt Jalandhar with regard to FIR no. 26 dated 02.04.2025, under Section 498-A, 495 IPC, P.S. Women Cell, Jalandhar with the intervention of respectable persons, vide compromise deed dated 19.11.2025, photocopy of which is Ex. Pl. The compromise is genuine and arrived with free will, consent and without any pressure, coercion and undue influence. He is not involved in any other criminal case or any other FIR. He has not been declared proclaimed person/offender in any criminal case. No other case is pending between them. Therefore, the present FIR may kindly be quashed in view of the above said compromise.

Further, IO ASI Tarsem Kaur No.493, posted at PS Women Cell, Jalandhar has suffered statement that she is Investigating Officer in the present FIR no. 26 dated 02.04.2025, SUMIT SINGLA 2026.04.22 19:11 I attest to the accuracy and integrity of this document CRM-M-67680-2025 (O&M) -4- under Section 498-A, 495 IPC, P.S. Women Cell, Jalandhar. There is only accused in the present FIR namely Aslam Khan and one complainant/aggrieved person namely Taj Bibi in the present case, who have appeared and made statement in the court. The accused is not involved in any other FIR and has not been declared proclaimed person/offender in the present case or any other proceedings or any FIR. No other criminal case is pending against the accused. It is also stated by her that during investigation of the present case, no additional accused has been added in the present FIR nor there has been any addition or deletion of any offence after the registration of the FIR. No investigation is pending against any of the accused nor any accused has been declared as innocent during investigation in the present case. He has further stated that challan has not been presented in the present case and is under investigation.

As per the record available with the court of undersigned and the statement of the IO ASI Tarsem Kaur No.493, posted at PS WomenCell, Jalandhar, there is only one accused namely Aslam Khan son of Sh. Anwar Hussain and one complainant/injured/aggrieved person namely Taj Bibi D/o Sh. Bashir Hussain in the present FIR no. 26 dated 02.04.2025, under Section 498-A, 495 IPC, P.S. Women Cell, Jalandhar and both of them have appeared and made statement in the court. No accused is absconding or declared Proclaimed person/ offender in the present case nor any criminal case or proceedings have been SUMIT SINGLA initiated or pending against them. As per the statement given by 2026.04.22 19:11 I attest to the accuracy and integrity of this document CRM-M-67680-2025 (O&M) -5- IO, during investigation of the present case, no additional accused has been added in the present FIR nor there has been any addition or deletion of any offence after the registration of the FIR. No investigation is pending against any of the accused nor any accused has been declared as innocent during investigation in the present case. The challan has not been presented in the present case. On the basis of statements given by the accused and the complainant, this Court is of the considered view that compromise effected between the parties is genuine and is effected voluntarily without any pressure, coercion or undue influence from any quarter."
4. Learned State counsel and learned counsel for respondent No.2 have not raised any dispute regarding the factum of compromise between petitioner and respondent no.2.
5. Since the matter has been amicably settled between the parties, continuation of the criminal proceedings would be an exercise in futility. The dispute which has its genesis in a matrimonial discord, warrants exercise of powers under Section 528 BNSS.
6. Following principles of law laid down by the Full Bench Judgment of this Court in "Kulwinder Singh and others Vs. State of Punjab and another" 2007(3) RCR (Criminal) 1052 and Hon'ble Supreme Court in "Gian Singh Versus State of Punjab and others" (2012) 10 SCC 303, the petition is allowed.
7. FIR No.26 dated 02.04.2025 under Sections 498-A, 495 Indian Penal Code, Police Station Women Cell, District Jalandhar Police SUMIT SINGLA 2026.04.22 19:11 I attest to the accuracy and integrity of this document CRM-M-67680-2025 (O&M) -6- Commissionerate and all consequential proceedings arising therefrom, are quashed qua the petitioner.
8. Pending miscellaneous applications, if any, stand disposed of.
